Terms and Conditions

Scope of Work and Standards

West Side Electric will provide all materials and perform work following industry standards and professional best practices. Unless explicitly stated otherwise, West Side Electric does not service or recommend the continued use of electrical panels manufactured by Federal Pacific, Zinsco, Wadsworth, or Pushmatic, as these panels are considered obsolete. All devices provided by the client for installation must be UL Listed. West Side Electric reserves the right to refuse installation of devices that do not meet this standard.

Exclusions

The scope of work does not include services or responsibilities unless explicitly stated. These exclusions include compliance with non-NEC codes, fireproofing, concrete cutting, patching or repair, temporary power, painting or drywall repair, correction of pre-existing wiring issues or code violations, seismic supports or structural reinforcements, and overtime or shift work.

Hourly Service Calls

Service calls are billed on a time and material basis. Each visit includes a flat service fee of $95 and a minimum one-hour labor charge of $195. After the first hour, labor is billed at $195 per hour, prorated in 15 minute increments. Permit fees are determined onsite and may include a $75 minor label permit or a minimum full permit fee of $300. A cancellation fee of $95 will apply for appointments cancelled with less than 24 hours’ notice.

Budgets

West Side Electric may provide a budget before the start of work. Budgets are not fixed bids and reflect pricing based on hourly rates. As budgets are often prepared without a site visit, they may not account for unforeseen conditions or additional materials required during the job.

Fixed Estimates

Fixed estimates include a detailed scope of work along with a set price for completing the job. These estimates are valid for 30 days unless otherwise stated. The fixed price covers everything outlined in the scope, and adjustments will only occur through a change order.

Troubleshooting

Troubleshooting is billed at standard time and material rates. Due to the nature of diagnostic work, the time required may vary based on factors such as the age of the system, accessibility, and existing conditions. Multiple visits may be necessary, especially in systems with unconventional or non-compliant wiring. Clients understand that additional issues may arise during the process and all time and materials will be billed accordingly.

Payment Terms

For projects over $1,000, a 50% deposit is required prior to scheduling. Progress payments will be due as the work advances. Invoices are sent via email, and billing typically runs about one week behind the date of service. Late payments will incur a service charge of 1.5% per month (18% annually). Clients are responsible for attorney fees and collection costs related to recovering overdue balances. West Side Electric reserves the right to file a lien on properties for unpaid balances on substantially completed work, including change orders. If a client chooses to provide a coupon, it must be requested from the program within 7 days of service, at the latest.

Material Availability and Pricing

Material availability and pricing are subject to market fluctuations. Any significant changes will be communicated to the client, and adjustments will be reflected in change orders.

Change Orders and Unexpected Conditions

Changes to the project scope resulting from client requests, unforeseen site conditions, or requirements from public utilities or authorities having jurisdiction will be documented through change orders. These changes may have an impact on the project’s cost and timeline. Delays caused by factors such as weather, material availability, permitting, or site conditions are beyond West Side Electric’s control.

Client Responsibilities

Clients are responsible for providing clear and timely access to the work area, including ensuring that all pets are secured in a contained area for the safety of our employees. Any delays or additional labor costs resulting from unmet responsibilities will be billed accordingly. If work is delayed or cannot proceed due to client-related issues, hourly rates will apply for waiting time. The property owner must ensure accurate contact and billing information is provided and updated throughout the project.

Site Access and Safety

Clients are responsible for maintaining a safe and accessible work environment. Hazards, including but not limited to asbestos or insulation, must be addressed and resolved before work begins. West Side Electric is not liable for injuries caused by unsafe site conditions.

Permits and Inspections

West Side Electric will obtain or sign onto all necessary permits for the work being performed. Any work completed by third parties under permits issued to West Side Electric will void all warranties. Please note that delays caused by permit processing or inspection scheduling are outside of West Side Electric’s control. Clients are responsible for ensuring access and availability for inspections. It is the responsibility of others to provide adequate clearance and maintain any code-required space. If required, permits for traffic control and right-of-way must also be obtained by others. If a job is cancelled after a permit has been pulled, West Side Electric will not be able to provide a full refund, as jurisdictions only refund a portion of the permit fees once issued.

Damage and Liability Waiver

Clients are required to relocate all fragile or valuable items before work begins. West Side Electric is not liable for incidental damage to such items. Damage to walls, floors, or other property may occur during necessary work, and West Side does not assume responsibility for such damage unless explicitly agreed upon in writing. West Side is not liable for damage to structural penetrations or elements, including drywall, flooring, countertops, siding, or roofing, unless specified in the scope of work.

Dispute Resolution

West Side Electric is committed to resolving disputes amicably. Mediation or arbitration will precede any legal proceedings, which will take place in Portland, Oregon.

Environmental and Regulatory Compliance

West Side Electric complies with all applicable environmental and regulatory standards. Clients are responsible for addressing pre-existing violations on their property and any associated fines or corrective measures.

Right to Terminate Services

West Side Electric reserves the right to discontinue services if contract terms are not upheld, including cases of non-payment, lack of access, or unsafe site conditions.

Force Majeure

West Side Electric is not responsible for delays or damage caused by events beyond its control, including natural disasters, or other unforeseen circumstances.

Warranty and Limitation of Liability

West Side Electric provides a one-year limited warranty on workmanship. This warranty excludes damages resulting from improper maintenance, unauthorized modifications, transfer of ownership, or work performed by others. Materials are covered under the manufacturer’s warranty. Liability is limited to the terms specified in this agreement.
